Holding and result

The court found that, although the plaintiff did not specifically plead his capacity, the plaint as a whole indicated he was a family member of the deceased and thus entitled to sue. However, the suit was filed more than twelve months after the death of the deceased, contrary to section 6(3) of the Law Reform (Miscellaneous Provisions) Act, Cap. 79. No disability or exception was pleaded to bring the action within time. The court held that statutory limitation periods are mandatory and not subject to the Limitation Act, Cap. 80, due to section 32 of that Act. As a result, the suit was time-barred and the plaint was rejected under Order 7 Rule 11 of the Civil Procedure Rules. Costs were awarded to the defendants.

Questions and positions

Legal issues

Party arguments

Applicant
Plaintiff's counsel argued that, although the plaint does not specifically plead the capacity, the plaintiff is a family member of the deceased and has incurred expenses on the deceased's estate, thus entitled to sue. Counsel requested the court to administer substantial justice without undue regard to technicalities.
Respondent
Defence counsel, Mr. Joseph Nyeko, raised two preliminary objections: first, that the plaintiff failed to state his capacity in bringing the suit; second, that the suit is time-barred under section 6(3) of the Law Reform (Miscellaneous Provisions) Act, Cap. 79, as it was filed more than twelve months after the death of the deceased. Counsel argued that the court is barred by law from granting any remedy in a time-barred suit.

05

Court’s reasoning

  1. 01

Section 6(1), Law Reform (Miscellaneous Provisions) Act, Cap. 79

Actions under the Law Reform (Miscellaneous Provisions) Act for the benefit of a deceased's family must be brought by an executor, administrator, or family member.

  2. 02

Section 6(3), Law Reform (Miscellaneous Provisions) Act, Cap. 79

Such actions must be commenced within twelve calendar months after the death of the deceased.

  3. 03

Order 7 Rule 11, Civil Procedure Rules; Iga v Makerere University (1972) EA 65; Onesifoko Bamuwayira & 2 Ors v Attorney General (1973) HCB 87; Pearl Motors Limited v Uganda Commercial Bank (1998) III KARL 1

A plaint that is time-barred or discloses no cause of action must be rejected by the court.

  4. 04

    Article 126(2)(e), Constitution of Uganda

Substantial justice shall be administered without undue regard to technicalities, subject to the law.

06

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • Substantial justice requires compliance with written law, especially where limitation periods are prescribed by statute.
  • Section 6(3) of the Law Reform (Miscellaneous Provisions) Act operates independently of the Limitation Act, Cap. 80.

Court disposition

plaint_rejected_as_time_barred

  • The plaint in this suit is rejected pursuant to Order 7 Rule 11 of the Civil Procedure Rules.
  • The defendant is awarded the costs of the rejected suit.
