Holding and result
The Court of Appeal found that the trial judge properly evaluated the evidence and correctly relied on the dying declaration, which was corroborated by the appellant's own admission to the deceased's mother. The medical evidence established that the injuries were consistent with an assault and not an accident, and the circumstances explained the absence of eyewitnesses. The court held that all the evidence on record irresistibly pointed to the appellant as the person who unlawfully assaulted the deceased, causing his death. The appeal was found to be without merit and was dismissed, upholding the conviction and sentence for manslaughter.
Court disposition

Questions and positions
Legal issues
- 01
Whether the trial judge erred in law by relying on the dying declaration without wholly evaluating corroborating evidence and the circumstances under which it was made.
- 02
Whether the conviction for manslaughter was proper in the absence of direct evidence connecting the appellant to the offence.
Party arguments
- Applicant
- Counsel for the appellant argued that the trial judge erred by convicting the appellant based on an uncorroborated dying declaration. He contended that the circumstances under which the declaration was made were not properly considered, and that the medical evidence did not support the use of a mingling stick as alleged. He further argued that there was no eyewitness to the assault and that the trial judge failed to properly evaluate the evidence, which should have led to an acquittal.
- Respondent
- The respondent, represented by the state attorney, opposed the appeal and supported the trial judge's decision. She argued that the dying declaration was made to multiple people and corroborated by the appellant's own admission to the deceased's mother. She submitted that the judge properly directed herself on the law and evidence, and that the lack of eyewitnesses was explained by the circumstances of the assault.

Court’s reasoning
Legal principles
- 01
Section 30(a) of the Evidence Act; Tindigwihure vs Uganda Criminal Appeal No. 9 of 1989
A dying declaration is admissible in evidence if made in expectation of death and can be relied upon if corroborated by other evidence.
- 02
Rule 30(1)(a) of the Judicature (Court of Appeal Rules) Directions
The appellate court has a duty to re-appraise evidence and draw its own inferences of fact, bearing in mind it did not see or hear the witnesses.
- 03
Simon Musoke v Republic [1958] EA 185; Bogere Charles vs Uganda SSCA No. 10 of 1999
Corroboration of a dying declaration can be found in the accused's own admission or other supporting evidence.
06
Ratio, limits and disposition
Ratio decidendi
The Court of Appeal found that the trial judge properly evaluated the evidence and correctly relied on the dying declaration, which was corroborated by the appellant's own admission to the deceased's mother. The medical evidence established that the injuries were consistent with an assault and not an accident, and the circumstances explained the absence of eyewitnesses. The court held that all the evidence on record irresistibly pointed to the appellant as the person who unlawfully assaulted the deceased, causing his death. The appeal was found to be without merit and was dismissed, upholding the conviction and sentence for manslaughter.
Obiter and limits
- The absence of eyewitnesses to an assault does not negate the reliability of a dying declaration when circumstances explain their absence.
- A dying declaration made to multiple persons and corroborated by the accused's admission strengthens its evidentiary value.
Court disposition
appeal dismissed; conviction and sentence upheld
- The appeal is dismissed.
- The conviction and sentence for manslaughter are upheld.
