Holding and result
The court held that section 184 of the Registration of Titles Act is an absolute bar to actions by lessees against lessors for recovery of land or relief against forfeiture, except in the limited circumstances expressly provided. The plaintiff's alternative prayers for relief against forfeiture cannot be maintained and must be expunged from the plaint. However, the law does not bar the plaintiff from seeking a declaration that the re-entry and the application to note the same were wrongful or in breach of contract. The preliminary objection succeeds in part, and the alternative prayers are struck out. Each party is to bear its own costs for the ruling.
Court disposition
Preliminary objection upheld in part; alternative prayers expunged; declaration claim remains; each party to bear own costs.
Orders
- Prayers in the alternative for relief against forfeiture are expunged from the plaint.
- Plaintiff may proceed with claim for declaration regarding wrongful re-entry and breach of contract.
- Each party to bear its own costs of this ruling.

Questions and positions
Legal issues
- 01
Whether the suit is barred by section 184 of the Registration of Titles Act.
- 02
Whether section 27 of the Judicature Statute 1996 confers jurisdiction to the High Court to entertain the suit based on the facts presented.
- 03
Whether the plaintiff can seek relief against forfeiture and other remedies against the defendant.
Party arguments
- Applicant
- Counsel for the plaintiff argued that the suit was properly brought under section 27 of the Judicature Statute 1996, as an action by a lessee seeking relief against forfeiture after the lessor exercised the right of re-entry. The plaintiff paid rent which was rejected by the lessor, leaving the lessee with no recourse but to proceed under the cited section.
- Respondent
- Counsel for the defendant objected that section 27 of the Judicature Statute 1996 does not apply, emphasizing that the Registrar of Title should have been made a party and that the suit is barred by section 184 of the Registration of Titles Act, which precludes actions by lessees against lessors in default.
05
Court’s reasoning
Legal principles
- 01
Section 184, Registration of Titles Act
Section 184 of the Registration of Titles Act bars actions of ejectment or recovery of land against the registered proprietor except in specified cases, and is an absolute bar and estoppel to such actions.
- 02
Section 27, Judicature Statute 1996
Section 27 of the Judicature Statute 1996 provides for relief against forfeiture, but its application is limited and does not override the bar under section 184 of the Registration of Titles Act.
- 03
The Executrix of the Estate of the Late Christine Mary Namatovu, Civil Suit No. 99 of 1987
Case law interprets section 184 as permitting actions by lessors against lessees in default, but not the reverse; lessees cannot bring actions for ejectment or recovery of land against lessors.
06
Ratio, limits and disposition
Ratio decidendi
Obiter and limits
- The law does not bar a plaintiff from seeking a declaration that the re-entry and the application that the same be noted are wrongful and or in breach of contract.
- The expression 'any rule of law or equity to the contrary notwithstanding' in section 184 is designed to rule out relief against forfeiture where the registered proprietor has re-entered.
Court disposition
Preliminary objection upheld in part; alternative prayers expunged; declaration claim remains; each party to bear own costs.
- Prayers in the alternative for relief against forfeiture are expunged from the plaint.
- Plaintiff may proceed with claim for declaration regarding wrongful re-entry and breach of contract.
- Each party to bear its own costs of this ruling.
