Applicant
The applicant/defendant argued that the plaintiffs' case is frivolous and vexatious, that he has a good defence with high chances of success, and that the first plaintiff is neither incorporated nor registered in Uganda while the second plaintiff does not reside or have assets in Uganda. He contended that, as both are outside the court's jurisdiction, execution of any costs order would be difficult and costly, potentially causing a miscarriage of justice. Respondent

The pro}{\lang1033\langfe2057\langnp1033\insrsid12086597 x}{\lang1033\langfe2057\langnp1033\insrsid7031308\charrsid9767376 imity of the two countries, the time and financial expenses, and even excha nge control regulations, as well as taxation policies etc. are some of the considerations the court should make. Where the judgement creditor lives in Uganda and the judgement debtor\rquote s property is in England, this court, taking into consideration other circumstances, would decline to order security for costs.
