Holding and result
The court found that the applicant's lease had been extinguished by the judgment in Civil Suit No. 99 of 2003 and subsequent re-entry and sale of the property by the first, second, and third respondents to the fourth respondent. The applicant did not appeal the judgment or seek to prevent the transfer of interests. The property is no longer owned by the original lessors, and granting relief would adversely affect the rights of the fourth respondent, a bona fide purchaser. The court held that relief against forfeiture is discretionary and should not be granted where it would cause injustice to third parties who have acquired interests in the property. The application was therefore dismissed with costs.

Questions and positions
Legal issues
- 01
Whether the applicant is entitled to relief against forfeiture under Section 25(4) of the Judicature Act.
- 02
Whether the sale of the suit property to the fourth respondent extinguished the applicant's rights under the sub-lease.
- 03
Whether granting relief would cause injustice to third parties who have acquired interests in the property.
Party arguments
- Applicant
- The applicant contends she is entitled to relief against forfeiture because she filed the application within six months of execution of the judgment in Civil Suit No. 99 of 2003. She argues that under Section 25(4) of the Judicature Act, the lessor can only deal with the suit property after expiry of six months from the date of execution of judgment. Therefore, the fourth respondent only acquired the reversion of the lease, and the lease is still subsisting between the tenant and lessor until the six months expire. She seeks relief for payment of rent and arrears on terms the court deems fit.
- Respondent
- The first, second, and third respondents argue that the judgment in Civil Suit No. 99 of 2003 extinguished the lease between them and the applicant, reinforced by their physical re-entry and possession. They assert that nothing in Section 25(4) prevents them from transferring their interests to third parties. The fourth respondent submits that at the time of purchase, the applicant's sub-lease had been determined and she has no cause of action against him. They further argue that relief against forfeiture cannot be granted where the parties have altered their positions and third-party interests would be unjustly affected.

Court’s reasoning
Legal principles
- 01
High Court Miscellaneous Cause No. 87 of 1971: In the Matter of Christopher Godfrey Kiwanuka Musisi & Another [1973] HCB 167
Relief against forfeiture is discretionary and should not be granted where it would cause injustice to third parties who have acquired interests in the property.
- 02
H.C.C.S No. 45/94 Mukasa Lubanga & others Vs. Combined Building Company Co [1995] IV KALR 88
Relief against forfeiture cannot be granted where parties have altered their positions, such as by selling or leasing the property to third parties.
- 03
Section 25(4), Judicature Act, Cap.13
Section 25(4) of the Judicature Act governs relief against forfeiture and the timing of lessor's dealings with the property post-judgment.
06
Ratio, limits and disposition
Ratio decidendi
Obiter and limits
- Relief against forfeiture is not automatic and must consider the interests of third parties who have acquired rights in the property.
- The applicant's failure to appeal or seek injunctive relief against the transfer of the property was fatal to her claim for relief.
Court disposition
application dismissed
- The application is dismissed with costs.
