I must now turn to the law and determine whether it is possible for this court to make the order sought.

It is clear that the applicants\hich\f0 \rquote \loch\f0 intention is to adopt the infant in question and intend to do so in the USA in case this application succeeds. Given that scenario I would have been inclined to find that the appl\hich\af0\dbch\af39\loch\f0 i\hich\af0\dbch\af39\loch\f0 cable law should be Section 46 of the Children Act which deals with inter-country adoption. In which case, this application, on its face, would have failed given the fact that the applicant}{\f0\fs24\insrsid13123675\charrsid10579038 \hich\af0\dbch\af39\loch\f0

C Kitumba, JA., disagreed. Though in agreement with the learned Deputy Chief Justice that this court had jurisdiction to grant orders of legal guardianship, the l \hich\af0\dbch\af39\loch\f0 e\hich\af0\dbch\af39\loch\f0 arned justice of appeal stated that it should not be applicable where the applicants were foreign applicants who did not qualify under Section 46 of the Children Act. To allow such applicants to obtain orders of legal guardianship, while they did not qual \hich\af0\dbch\af39\loch\f0 i\hich\af0\dbch\af39\loch\f0 fy to adopt the children under the Act, would be an infringement of the Act. A Twinomujuni, JA., did not agree that the High Court had the power to grant orders of legal guardianship, such power being only available to Family and Children\hich\f0 \rquote \loch\f0 s Court, by the \hich\af0\dbch\af39\loch\f0 i\hich\af0\dbch\af39\loch\f0 ssue of care orders and appointment of Foster Parents. Nevertheless he concurred in the granting of the order of guardianship proposed by

In the result, perhaps, I must turn to simply one question. Is the grant of such an order in the best interest of the children?

The child\hich\f0 \rquote \loch\f0 s curren\hich\af0\dbch\af39\loch\f0 t circumstances as a ward of an orphanage w}{\f0\fs24\insrsid11299120\charrsid10579038 \hich\af0\dbch\af39\loch\f0 ere}{\f0\fs24\insrsid4597273\charrsid10579038 \hich\af0\dbch\af39\loch\f0 only intended to be temporary, pending the availability of a suitable home in which she could be raised. Unfortunately no suitable home has been available locally since she was picked up abandoned.

Institution\hich\af0\dbch\af39\loch\f0 al upbringing denies children their natural and legal rights of being raised by their parents whether natural or adopted. \par }\pard \s15\ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10579038 {\f0\fs24\insrsid4597273\charrsid10579038 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid4597273\charrsid10579038 \hich\af0\dbch\af39\loch\f0 14.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl360\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls2\adjustright\rin0\lin720\itap0\pararsid10579038 {\f0\fs24\insrsid4597273\charrsid10579038 \~\hich\af0\dbch\af39\loch\f0 No governmental support, be it local or central, is available for the care and upkeep of children in distress generally or specifica\hich\af0\dbch\af39\loch\f0 lly in the case of this infant. Right now the infant is under the care of a local non-governmental organisation. There is no offer from Ugandans or non-Ugandans resident in Uganda to adopt this child. It is imperative that her stay in an institution be te \hich\af0\dbch\af39\loch\f0 r\hich\af0\dbch\af39\loch\f0 minated as soon as possible. I find therefore that exceptional circumstances exist for an order to be made in favour of non citizen}{\f0\fs24\insrsid6251795\charrsid10579038 \hich\af0\dbch\af39\loch\f0 s}{\f0\fs24\insrsid4597273\charrsid10579038
