01

Holding and result

The court found that the applicant had sufficient interest in the matter as the transportation fees directly affected him. The application was filed within the prescribed three-month period, as the relevant action by the respondent occurred on 6th August 2004. The court considered whether it was just and convenient to grant leave for judicial review, noting that the relief sought would affect only the applicant while other transporters continued to pay the fees. The court acknowledged the urgency due to the threat of imminent action by the respondent and the statutory notice requirement that could delay access to justice. The court exercised its discretion to grant leave, but imposed conditions to ensure fairness, including the deposit of the outstanding fees in court and a stay of further enforcement actions until the main application is heard.

Court disposition

Leave granted to apply for judicial review, subject to conditions.

Orders

  • Leave is granted to the applicant to apply for an order of certiorari, prohibition, and a declaration.
  • Leave is conditional on the applicant depositing the outstanding payments of Shs. 339,300 with the Registrar of the Court within 14 days.
  • The interim order dated 16 August 2004 is vacated and replaced with a stay restraining the respondent and its agents from taking legal action against the applicant or demanding further taxes beyond the deposited amount until final disposal of the application.
  • The applicant shall serve the respondent with the motion through the respondent's lawyers within 14 days of this ruling.
  • The motion shall be heard on 12 October 2004.

Questions and positions

Legal issues

Party arguments

Applicant
The applicant, a businessman in passenger transportation, contends that the transportation fees levied by Masindi Town Council are illegal and that their imposition on him is unjust. He seeks leave to apply for judicial review to challenge the legality of these fees and requests interim relief to prevent enforcement actions against him pending determination of the main application.
Respondent
The respondent did not appear at this ex parte stage, but the court noted that the municipality relies on such fees for its operations and that an interim injunction had already restrained the respondent from levying these taxes on the applicant alone, not on other owners.

05

Court’s reasoning

  1. 01

Order 42(A) rule 2 of the Civil Procedure Rules; The Civil Procedure (Amendment) (Judicial Review) Rules, 2003

Leave to apply for judicial review is granted at the court's discretion, considering sufficient interest, timeliness, and whether it is just and convenient to grant such leave.

  2. 02

Order 42(A) rule 5 of the Civil Procedure Rules

Applications for judicial review must be made within three months from when the grounds arose, unless there is good reason for delay.

  3. 03

Order 42(A) rule 7 of the Civil Procedure Rules

A declaration or injunction may be granted on an application for judicial review if it is just and convenient to do so.

06

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • The action, though affecting only one person, has wider consequences for the municipality's revenue.
  • It would have been possible for the applicant to file a suit for a declaration under Order 2 rule 7, but judicial review was appropriate due to the urgency and statutory notice requirements.
  • Granting leave with terms is necessary to avoid unjust enrichment of the applicant at the expense of other transporters.

Court disposition

Leave granted to apply for judicial review, subject to conditions.
