01

Holding and result

The court found that the applicant, as the mother and sole caretaker of the minors, sought guardianship and authority to mortgage the minors' land solely for their welfare and advancement. The minors are registered proprietors of the land, which contains their home and income-generating assets. The applicant demonstrated that the proposed loan would be used to capitalise the hotel and cattle farm, directly benefiting the minors. No evidence was presented to suggest the application was contrary to the minors' interests. The court applied the principle that the welfare of the child is paramount and concluded that granting the guardianship and mortgage authority was in the best interests of the minors.
