Holding and result

Applicant
The applicant argued that failure to enter appearance and file a defence was due to his advocate's negligence, not his own. He claimed he had good defences and was always willing to defend the suit. He further stated that a warrant of attachment had been issued against his motor vehicle and that unless execution was stayed, he would suffer irreparable loss. He prayed for the stay to enable him to prosecute the pending application to set aside the ex parte judgment.
Respondent
The respondent opposed the application, arguing that the supporting affidavit was false. He stated there was no pending execution against the applicant's motor vehicle as it was found not to belong to the applicant.
