Holding and result

The court found that the claim for arrears prior to 11th January 2002 was time barred under Section 3(2) of the Civil Procedure and Limitation (Miscellaneous Provisions) Act. The admissible claim was for arrears within three years preceding the filing of the suit. Documentary evidence, including a letter from the defendant, confirmed an agreement to pay Shs.2,000,000.00 per month to the plaintiffs. The defendant's contention of entitlement to only 30% of net collections was unsupported by evidence. The court awarded the plaintiffs Shs.72,000,000.00 for 36 months of arrears, interest at 20% per annum from the date of filing to judgment, and thereafter at court rate until payment in full. General damages of Shs.10,000,000.00 and costs were also awarded for inconvenience and breach of contract.

Court disposition

judgment for the plaintiffs in part; claim prior to 11th January 2002 struck out as time barred.

Orders

Questions and positions

Legal issues

Party arguments

Applicant
The plaintiffs, as administrators of the estate of the late Stanley Kizza Kizito, claim arrears of agreed rent at Shs.2,000,000.00 per month, totaling Shs.111,638,200.00, plus interest, general damages, and costs. They assert that the defendant, Kawempe Division, managed Kizito Market on their land since October 1999 and was contractually obligated to remit monthly payments. They accept that limitation applies but argue the cause of action arose from September 2003, making the claim timely.
Respondent
The defendant, a local authority, denies any contract or agreement to pay Shs.2,000,000.00 per month. It admits managing the market but contends that the plaintiffs are only entitled to 30% of net collections per month. The defendant argues that any claim beyond three years is time barred under the Civil Procedure and Limitation (Miscellaneous Provisions) Act, and that Shs.54,000,000.00 of the claim should be struck out.

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • The explanation of the plaintiffs' counsel regarding the accrual period was found to be disingenuous and unsupported by the evidence.
  • The defendant's failure to adduce evidence in support of its pleadings weakened its case and left the plaintiffs' evidence unchallenged.
  • Documentary proof of the plaintiffs' efforts to recover the agreed sums was available and demonstrated persistent inconvenience caused by the defendant.

Court disposition

judgment for the plaintiffs in part; claim prior to 11th January 2002 struck out as time barred.

  • Defendant to pay Shs.72,000,000.00 to the plaintiffs as arrears of rent for 36 months up to the date of filing suit, less any amount already admitted and paid.
  • Interest at 20% per annum from the date of filing suit to the date of judgment, and thereafter at court rate until realization in full.
  • General damages of Shs.10,000,000.00 awarded to the plaintiffs.
  • Defendant to pay costs of the suit.
