Holding and result

Counsel for the appellant argued that the courts below failed to consider that the appellant had been beaten before making the charge and caution statement, which was treated as a confession. He contended that the Court of Appeal did not consider the statement in its entirety and ignored the participation of PW3, an alleged accomplice, whose evidence should have been scrutinized. In her view, their findings and decisions were correct and cannot be faulted. His claim that he confessed because of beating is not true since the assault on his person was by a

crowd which was chasing him after the murder and robbery had been reported and before he made his confession to the pol ice officer, AIP Katabarwa. In our view therefore, the trial court and the Court of Appeal were correct in holding that the confession had been made voluntarily and was therefore admissible. \par }\pard \s15\qj \li0\ri0\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid3830249 {\insrsid3153003\charrsid3830249 \par }\pard \s15\qj \li0\ri0\sb230\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid3830249 {\cs24\insrsid3153003\charrsid3830249 In the confession, the appellant revealed the whereabouts of the murder weapon which only the user could have known. In any event, the evidence of PW }{\cs29\insrsid3153003\charrsid3830249 3 }{\cs24\insrsid3153003\charrsid3830249 and PW 4 corroborated his confession. Whether or not the evidence of PW }{ \cs29\insrsid3153003\charrsid3830249 3 }{\cs24\insrsid3153003\charrsid3830249 as an alleged accomplice should have been ignored or not, would not have, in our opinion advanced the case for the defence any further.
