01

Holding and result

The court found that the proceedings had deviated from the main application for leave to appeal out of time and were instead investigating allegations of fraud and forgery that had not been properly pleaded. This constituted a procedural irregularity. The court held that the justice of the case required discontinuing the current proceedings and setting aside all impugned orders, remitting the file to the Deputy Registrar for proper taxation of the Advocate-Client Bill of Costs inter partes. The court emphasized that any investigation into fraud should only occur if properly pleaded and supported by evidence, and that the applicant's right to be heard must be protected to avoid multiplicity of proceedings.

Questions and positions

Legal issues

Party arguments

Applicant
The applicant contends that the respondent did not serve the Advocate-Client Bill of Costs as required by law, that the instruction fee claimed was fraudulent and contrary to the parties' agreement, and that taxation proceeded ex parte without proper service of the bill or hearing notice. The applicant argues it is just and equitable for the orders sought to be granted.
Respondent
The respondent alleges that the vouchers relied upon by the applicant are forged and that payments claimed to have been made were never received. The respondent requested the applicant to produce records to verify the authenticity of the vouchers and maintains that the orders obtained were not manipulated.

05

Court’s reasoning

  1. 01

Civil Procedure Rules, Order 51 Rule 6 and Order 52 Rules (1) and (2)

Court has inherent power to make orders necessary for the ends of justice or to prevent abuse of process.

  2. 02

Advocates Act, Sections 57 and 58

Fraud must be pleaded and proved by evidence that can be tested under cross-examination; burden is higher than ordinary complaints.

  3. 03

    General principles of natural justice

A party must not be condemned unheard; right to fair hearing is fundamental.

06

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • Allegations of fraud are serious and require proper pleading and proof.
  • Investigating fraud without proper pleadings is a procedural irregularity.
  • The court's inherent powers must be exercised to prevent abuse of process and ensure justice.
  • Multiplicity of proceedings should be avoided by determining parties' rights once for all.

Court disposition

application_discontinued

  • All impugned orders are set aside.
  • File remitted to Deputy Registrar for taxation of Advocate-Client Bill of Costs inter partes.
  • Costs to abide the outcome in HCMA NO. 112/2008.
